• Contract – where processing is necessary to provide the services you request, such as creating accounts, organising fundraising events or processing donations.
• Legal obligation – where processing is necessary to comply with legal requirements, such as handling Gift Aid information or responding to lawful requests from authorities.
• Legitimate interests – where processing helps us operate, improve and protect the uGather platform.
• Consent – where you have given permission for optional features such as location services.

5. Donations and payment processing

Donations made through uGather are processed by Stripe, a secure third-party payment processor.

uGather never collects, stores or has access to payment card details.

Donation information such as donor name, message and donation amount may be shared with the relevant charity or fundraiser to support the event.

Gift Aid information

If a donor chooses to add Gift Aid to a donation, additional information may be required to allow the charity to claim Gift Aid from HM Revenue and Customs (HMRC).

• The donor’s full name
• The donor’s home address
• Confirmation that the donor is eligible to claim Gift Aid

This information is collected solely for the purpose of enabling the receiving charity to submit a Gift Aid claim to HMRC.

Gift Aid information will be shared with the charity receiving the donation and may be submitted by the charity to HMRC as part of their Gift Aid claim.

Gift Aid declarations are made by the donor and must be accurate at the time they are given.

uGather facilitates the Gift Aid declaration process but is not responsible for verifying a donor’s tax status or eligibility.

Donor information visibility

When you make a donation through uGather, certain information may be shared with the charity or fundraiser associated with the event.

• Donation amount
• Donation message (if provided)

Donors may have the option to donate anonymously where this feature is available.

Charities as independent data controllers

When personal data is shared with a charity in connection with a donation or fundraising activity, the charity becomes responsible for its own use of that information in accordance with its own privacy policy and applicable data protection laws.

uGather is not responsible for how charities process personal data once it has been shared with them.

Charity accounts and payment setup

Charities that use uGather to receive donations must create an account on the platform.

To receive donations, charities must also connect a payment account through our payment processor, Stripe.

During this process, charities may be required to provide information directly to Stripe for identity verification, regulatory compliance and payment processing.

uGather does not store charity bank account details.

6. Location services (GPS)

uGather may use your device’s location services to support certain features of the platform.

• Enable fundraisers to collect donations during events
• Allow users to create and define fundraising routes
• Help display or promote relevant fundraising events or charities in a user’s local area
• Support event functionality within the app

Location access is optional and will only be used if you grant permission through your device settings or within the uGather app.

uGather does not use continuous background location tracking.

When users create fundraising routes, location data may be stored as part of that route and linked to the user’s account in order to support platform functionality.

Your location will not be shared publicly unless the fundraiser explicitly enables location sharing within the app.

Location services depend on device capabilities, operating system permissions and network availability. As a result, location features may not always function or be accurate.

uGather does not sell personal data or precise location data to third parties.

7. Sharing of information

We may share limited information with:

• Charities and fundraisers associated with an event
• Trusted service providers that help operate the platform
• Payment processors such as Stripe

These providers only process information necessary to operate the service.

8. International data transfers

Some service providers used to operate the uGather platform may process or store information outside the United Kingdom.

Where this occurs, we take reasonable steps to ensure appropriate safeguards are in place to protect personal data and ensure it is handled in accordance with applicable data protection laws.

We take reasonable steps to protect your information from unauthorised access, misuse or disclosure.

We retain personal information only for as long as necessary to operate the platform, comply with legal obligations or resolve disputes.
